What are Standard Contractual Clauses?
Standard Contractual Clauses (SCCs) are a set of legally binding contractual terms issued by the European Commission.
They are designed to:
- Enable international data transfers outside the EEA
- Ensure GDPR-level protections are maintained
- Define obligations for data exporters and importers
- Provide enforceable rights for data subjects
How Pirsonal uses SCCs
Pirsonal incorporates the latest version of the SCCs:
Standard Contractual Clauses (SCCs)
These are applied as follows:
- Module 2 (Controller → Processor):
Used when Pirsonal processes personal data on behalf of its customers - Module 3 (Processor → Processor):
Used where Pirsonal engages Subprocessors
The SCCs are incorporated into Pirsonal’s Data Processing Addendum (DPA) as:
Annex IV — Standard Contractual Clauses
How SCCs work with Pirsonal’s safeguards
SCCs are implemented alongside additional safeguards, including:
- Technical and Organizational Measures (TOMs)
- Transfer Impact Assessments (TIA)
- Subprocessor due diligence and contractual controls
- Flexible data residency options (EU, US, hybrid)
Together, these measures support secure and compliant international data transfers.
Data transfer flexibility
Pirsonal supports multiple deployment models depending on customer requirements:
- EU-based infrastructure
- US-based infrastructure
- Hybrid configurations
The applicable transfer mechanism (including SCCs) depends on the selected configuration and applicable legal requirements.
